EPA Proposing more new regulations for SPCC On October 15, 2007, EPA published in the Federal Register proposed rule to clarify certain aspects of its new SPCC regulations. One of the rules is clarification on how to perform "integrity testing" on a 55-gallon container. EPA is now proposing that it may be acceptable for visual inspection to satisfy the integrity testing requirement. Full text of the proposed regulations can be found here. New SPCC Plan Changes: If you have less than 10,000 gallons of oil above ground, you no longer have to have professional engineers to certify your plan. The plant manager can self-certify it. However, you must meet certain spill history requirements. For example, you must not have more than a single spill of greater than 1000 gallons or 2 incidents of 42 gallons each in the past three years. This new rule becomes effective on Feb 26, 2007. ![]()
